HHS Issues Statement on Illegals, Abortion, And Constitutional Rights

The Trump administration just made a move sure to tweak two of the Left’s most incorrigible factions: advocates for illegal immigrants and supporters of abortion-on-demand.

Politico reports that the Trump administration has made a point of actively resisting attempts of pregnant illegal immigrants in their custody from obtaining abortions.

Instead, they are requiring them to visit crisis pregnancy centers, instructing shelter staff to block abortion-seeking minors from meeting with attorneys, requiring shelters to contact their parents regardless of whether a judge has already waived parental consent or notification. In some cases, there will be personnel from the US Department of Health and Human Services personally meeting with them to discourage them from having their babies killed.

Naturally, this has provoked the ire of the horrendously-misnamed American Civil Liberties Union. But Team Trump is standing firm, including the following statement which is sure to make liberals’ heads explode:

“The Office of Refugee Resettlement is providing excellent care to this young woman and her unborn child and fulfilling our duty to the American people. There is no constitutional right for a pregnant minor to illegally cross the U.S. border and get an elective abortion while in federal custody,” the Administration for Children and Families said in a a statement. “We cannot cede our responsibility to care for minors and their babies by releasing them to ideological advocacy groups.”

The Daily Caller News Foundation has more on the matter, including the ACLU’s legal battle to get a teenage illegal immigrant an abortion in Texas:

The ACLU’s original lawsuit posited that the HHS violated the First Amendment by refusing the girl an abortion. Even though the 17-year-old illegal immigrant received a judicial waiver allowing her — a minor — to get an abortion, the officers detaining her refused to take her to an abortion clinic, according to the Associated Press. The ACLU hoped to get an emergency court order from a judge allowing the girl to have an abortion.

Illegal immigrants do not have a constitutional right to abortion, Texas Attorney General Ken Paxton said in regard to the case. Ruling in the girl’s favor would “create a right to abortion for anyone on earth who enters the U.S. illegally,” Paxton said. “And with that right, countless others undoubtedly would follow. Texas must not become a sanctuary state for abortions.”

Exactly right, and if we were teaching proper constitutional education in this country, it wouldn’t even need to be said.

First of all, the simple fact is that nobody has a constitutional right to an abortion in the Untied States; the “right” was invented out of thin air by a Supreme Court ruling that even scores of pro-abortion legal scholars admit is a sham.

But even if we did accept that the Supreme Court pretending something was in the Constitution makes it so, it still wouldn’t mean that the “right” extended to illegal immigrants. While the Constitution obviously says there are some things that can’t be done to any person on American soil, regardless of their legal status, it also makes clear that most of the specific rights it spells out are specifically for American citizens.

For instance, the Fourteenth Amendment distinguishes between “privileges or immunities of citizens of the United States” and the deprivation of “any person’s” right to “life, liberty, or property” without due process of law.

Liberals can’t argue with a straight face which category abortion belongs to for one simple reason: abortion isn’t mentioned or alluded to anywhere in the Constitution. It’s simply something not even remotely considered.

Sadly, that won’t stop the Left from trying to make every preborn baby they can legally killable. Thank God for an administration willing to resist them.
